§ 2-19. Smoking prohibited in buildings owned or controlled by city.

  • Smoking is prohibited in all buildings owned by the City of Citronelle or that are controlled by the City of Citronelle, except at any area of the restaurant on the second floor of the main building at the municipal golf course that may be designed [designated] by the tenant as a "smoking area."

    Any person violating the terms of this section shall be guilty of an offense that shall be charged on a unified judicial system form ARJA-20 and, upon conviction, shall be fined not less than fifty dollars ($50.00) nor more than one hundred fifty dollars ($150.00) plus costs. However, the accused has the option of pleading guilty before the magistrate in person and paying a fine of twenty-five dollars ($25.00), or by signing the back of the complaint and paying the fine by mail, if this is done within ten (10) days of receiving the citation.

    This section shall be effective immediately upon its adoption and publication as provided by law. The city public works supervisor shall install appropriate signs at the entrances to the buildings.
